All fees are non-refundable except as required by law. Prices may change with 30 days notice.
Listing Labs Property: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and AI models, are owned by Listing Labs and protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of any listing URLs, analysis results, and data you provide to the Service. By using the Service, you grant Listing Labs a license to store, process, and use your data solely to provide the Service.
AI Suggestions: AI-generated copy suggestions and recommendations are provided for your use. You are responsible for reviewing and ensuring any AI-generated content complies with platform policies and applicable laws before publishing.
The Service collects publicly available data from Airbnb and VRBO listings, including:
This data is publicly accessible and collected for analytical purposes only. We do not access or collect private host dashboards, booking calendars, or personal communications.
You acknowledge and agree that Listing Labs may collect and analyze competitor data on your behalf as part of the Service.
Service Availability: We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.
Data Accuracy: While we strive for accuracy, AI analysis and recommendations are provided "as is" without warranty. You should verify all recommendations before implementing changes to your listings.
External Data: The accuracy of competitor and market data depends on the availability and reliability of external sources (Airbnb, VRBO). We are not responsible for errors or omissions in third-party data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRListingLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL DRListingLABS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Listing Labs, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
By You: You may terminate your account at any time by accessing your account settings or contacting customer support. Upon termination, your access to the Service will cease, and you will not be entitled to any refund of fees paid.
By Listing Labs: We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your data will be retained in accordance with our Privacy Policy.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.
Listing Labs reserves the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice on the platform. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the courts of the Dominican Republic.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Listing Labs.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms at any time.
